Privacy Policy

This Privacy Policy explains how Goxee Dealer Corp ("Goxee," "we," "us," or "our") collects, uses, discloses, retains, and protects Personal Information. It also explains the privacy choices that may be available to you.‌

"Personal Information" means information that identifies, relates to, describes, or could reasonably be linked with an individual or household. It does not include information that applicable law treats as public, aggregated, or deidentified.‌

1. Scope and Goxee's Role‌‌

This Privacy Policy applies to Personal Information Goxee handles through websites and Services that link to this Policy, business-account registration and administration, sales and demonstrations, onboarding, billing, support, and other interactions with Goxee.‌

Goxee handles Personal Information in two different roles:‌

1. For Goxee's own business operations.‌ Goxee determines why and how it uses information concerning website visitors, business contacts, customer administrators, subscriptions, billing, security, and direct communications with Goxee.‌
2. For dealerships and other business customers.‌ A dealership may use Goxee's Services to collect and process information about its customers, prospects, employees, users, inventory, applications, transactions, and communications ("Customer Personal Data"). The dealership determines why and how that information is used. Goxee processes Customer Personal Data on the dealership's behalf as a service provider or processor under the applicable agreement and the Goxee Data Processing Addendum (the "DPA").‌

If your information was submitted through a dealership's form, website, account, message, telephone call, or other interaction, you should ordinarily direct your privacy request to that dealership. Goxee will assist the dealership as required by the DPA and applicable law.‌

This Policy does not apply to a third-party website, service, or customer-connected integration that has its own privacy policy, even if Goxee links to or integrates with it.‌

2. Personal Information Goxee Handles‌‌

The information Goxee handles depends on how you interact with Goxee or a dealership using the Services.‌

2.1 Website, Business-Contact, and Account Information‌‌

Goxee may collect:‌

• name, dealership or business name, job title, postal address, telephone number, and email address;‌
• account identifiers, login information, permissions, authentication information, and account activity;‌
• requested or subscribed Services, Subscription and billing information, invoices, transaction status, support history, and business communications;‌
• information submitted through a request, demonstration, onboarding, support, or other form; and‌
• feedback, survey responses, and other information you choose to provide.‌

2.2 Technical and Usage Information‌‌

Goxee may collect IP address, browser and device type, operating system, referring URL, pages or features used, timestamps, diagnostic information, security events, and other system or activity logs needed to operate, secure, support, and improve its websites and Services.‌

Goxee may use essential first-party cookies or similar storage needed for account access, security, requested functionality, and user preferences. Goxee does not use third-party advertising pixels, cross-context behavioral advertising, or third-party session-replay or behavioral-analytics tools on its website.‌

2.3 Customer Personal Data Processed for Dealerships‌‌

Depending on the dealership's configuration and use of the Services, Customer Personal Data may include:‌

• names, telephone numbers, email addresses, postal addresses, and other contact information;‌
• vehicle, inventory, lead, inquiry, appointment, sales, service, transaction, and customer-relationship information;‌
• website forms, messages, emails, chats, telephone calls, recordings, voicemail, photographs, documents, transcripts, and communication metadata;‌
• marketing preferences, consent records, opt-out records, suppression records, and communication history;‌
• dealership employee or authorized-user information, including employer, title, role, permissions, account activity, and optional coaching information;‌
• credit applications and information entered into those applications, including Social Security numbers, driver’s-license information, employment information, income information, and related application details; and‌
• prompts, transcripts, summaries, suggestions, and other outputs created through enabled automated or artificial-intelligence features.‌

Goxee does not intentionally collect bank-account credentials, precise geolocation, biometric information, or information known to concern a minor through the Services. Payment-card information is collected and processed directly by Goxee's payment processor; Goxee may receive limited billing, transaction, and payment-status information but does not store full payment-card credentials.‌

3. Sources of Personal Information‌‌

Goxee may receive Personal Information:‌

• directly from you;‌
• from a dealership, employer, account administrator, or authorized user;‌
• from your use of a Goxee website, account, form, message, or Service;‌
• from dealership systems and integrations the dealership connects to its account;‌
• from communications carriers, payment processors, cloud providers, and other companies that help provide the Services; and‌
• from public business information where permitted by law.‌

4. How Goxee Uses Personal Information‌‌

Goxee may use Personal Information to:‌

• provide, configure, operate, maintain, secure, and support websites, accounts, and Services;‌
• establish and authenticate accounts and manage permissions;‌
• process Subscriptions, payments, invoices, taxes, and related business records;‌
• respond to inquiries, demonstration requests, onboarding needs, and support requests;‌
• transmit, route, store, record, transcribe, summarize, or analyze communications as directed by the applicable dealership;‌
• provide requested forms, customer-relationship workflows, credit-application functionality, communications, and integrations;‌
• provide optional automated suggestions, summaries, outputs, and coaching tools;‌
• understand usage, measure performance, diagnose problems, conduct research, and improve functionality;‌
• communicate about accounts, Services, security, updates, and offers as permitted by law;‌
• detect, investigate, prevent, and respond to fraud, misuse, security incidents, unlawful activity, and violations of Goxee's agreements;‌
• enforce agreements, collect amounts owed, protect rights and safety, resolve disputes, and comply with law; and‌
• create aggregated or deidentified information that Goxee maintains in a form that cannot reasonably be linked to an individual or dealership.‌

Goxee will not use Customer Personal Data for a purpose outside the applicable dealership's instructions, the agreement, the DPA, or applicable law.‌

5. How Goxee Discloses Personal Information‌‌

Goxee does not sell leads, Customer Personal Data, or other Personal Information. Goxee does not allow advertising partners to use Personal Information for their own advertising and does not disclose Personal Information in exchange for money.‌

Goxee may disclose Personal Information in the following circumstances:‌

5.1 Dealerships and Authorized Users‌‌

Goxee makes Customer Personal Data available to the dealership that controls the applicable account and to users the dealership authorizes, according to the dealership's instructions and account configuration.‌

5.2 Service Providers‌‌

Goxee uses contracted providers for cloud hosting and storage, communications infrastructure, transcription, artificial-intelligence processing, payment processing, security, and other technical functions needed to provide the Services. These providers may process Personal Information only to perform contracted services or as otherwise permitted by law. Providers that process Customer Personal Data are subject to contractual confidentiality, security, and data-processing obligations.‌

5.3 Customer-Connected Integrations‌‌

A dealership may connect its account to a third-party system or direct Goxee to transmit information to another provider. The dealership controls that connection. The third party's own contract and privacy policy govern its independent use of the information.‌

5.4 Professional Advisers and Business Transactions‌‌

Goxee may disclose information to attorneys, accountants, auditors, insurers, financing sources, and other professional advisers. Goxee may also disclose information in connection with an actual or proposed financing, merger, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction, subject to appropriate confidentiality and legal requirements.‌

5.5 Legal, Security, and Safety Purposes‌‌

Goxee may disclose information when reasonably necessary to comply with law or legal process; enforce an agreement; collect amounts owed; detect or prevent fraud or security incidents; protect the rights, property, or safety of Goxee, a dealership, another person, or the public; or establish, exercise, or defend a legal claim.‌

6. Dealership Text Messages‌‌

Dealerships may use Goxee's Services to send both transactional and marketing text messages. The message is branded as coming from the sending dealership, and the dealership determines the recipients, content, purpose, and timing.‌

Dealerships collect consent through their own forms and are responsible for providing legally required disclosures and obtaining the consent required for each message. Goxee processes the telephone number, consent and opt-out records, message content, delivery information, and related metadata on the dealership's behalf.‌

Message frequency varies, and message and data rates may apply. Replying STOP‌ automatically suppresses further messages through the applicable program. Replying HELP‌ sends a request to the dealership that is sending the messages so the dealership can provide assistance. Carriers are not liable for delayed or undelivered messages.‌

Goxee does not sell mobile telephone information or disclose it to third parties for their own marketing or promotional purposes. Goxee may provide information to contracted communications carriers and technical providers as necessary to deliver messages, register messaging programs, document consent, honor opt-outs, prevent abuse, and comply with law.‌

7. Call Recording, Transcription, and AI Features‌‌

A dealership may enable optional features that record, transcribe, summarize, analyze, or generate suggestions from telephone calls, text messages, chats, emails, metadata, and other Customer Personal Data. The dealership controls whether and how it uses these features and is responsible for providing required notices and obtaining legally required consent.‌

Goxee uses an application programming interface to send the information needed for artificial-intelligence processing to a contracted provider. That API account is configured so API content is not used to train the provider's models and Zero Data Retention is enabled. Goxee separately stores prompts, transcripts, and outputs to provide the enabled feature while the dealership's account remains active.‌

Goxee does not use Customer communication content to train generalized artificial-intelligence models or for Goxee's own advertising. Automated outputs may be inaccurate or incomplete and are intended to assist, not replace, human judgment. Goxee does not use those outputs for its own hiring, firing, compensation, employee discipline, credit, financing, or other legally significant decisions.‌

8. Retention and Deletion‌‌

Goxee retains Customer Personal Data, including credit applications, communications, recordings, transcripts, prompts, and outputs, while the applicable dealership account remains active.‌

After the account closes, Goxee will delete Customer Personal Data from active production systems within thirty (30) days and from backups within ninety (90) days, unless a longer period is required by law or necessary to preserve information relating to an active dispute, security incident, or legal hold. Information retained under an exception remains protected and is used only for the applicable purpose.‌

Goxee retains billing records indefinitely as business records. Full payment-card credentials are maintained by the payment processor, not Goxee.‌

Goxee retains consent, opt-out, suppression, complaint, and legal-compliance records for as long as reasonably necessary to demonstrate compliance and honor communication choices. Website inquiries, account records, support records, and system or security logs are retained for as long as reasonably necessary for the purpose for which they were collected, security, fraud prevention, dispute resolution, and legal compliance.‌

Aggregated or deidentified information that is no longer Personal Information may be retained for research, analytics, security, and Service improvement.‌

9. Security‌‌

Goxee maintains safeguards designed to protect Personal Information against unauthorized access, use, alteration, or disclosure. Confirmed safeguards include:‌

• encryption of Personal Information in transit and at rest;‌
• multifactor authentication for privileged production access;‌
• role-based access controls and access reviews;‌
• security logging and monitoring; and‌
• backup and recovery procedures.‌

No system, transmission, or storage method is completely secure. Dealerships and users are responsible for protecting credentials, managing authorized users, configuring available security features, and promptly notifying Goxee of suspected unauthorized access.‌

10. Privacy Choices and Requests‌‌

You may unsubscribe from Goxee marketing emails by using the unsubscribe method in the message. For dealership text messages, reply STOP‌ as described in Section 6.‌

Depending on applicable law, you may have rights to request access to, correction of, or deletion of Personal Information; obtain a copy of certain information; withdraw consent; or appeal a denied privacy request. Goxee does not unlawfully discriminate against a person for exercising an applicable privacy right.‌

To submit a request concerning Personal Information Goxee controls for its own purposes, email privacy@goxeedealer.com. Goxee may request information reasonably necessary to verify identity and authority. An authorized agent may submit a request where permitted by law, subject to reasonable proof of authorization.‌

If your request concerns Customer Personal Data controlled by a dealership, identify the dealership. Goxee may direct or forward the request to that dealership because the dealership is responsible for responding.‌

11. Children's Privacy‌‌

Goxee's websites and Services are intended for businesses and are not directed to minors. Goxee does not knowingly collect Personal Information from anyone under sixteen (16) years of age. Dealerships must not submit information known to concern a minor through the Services.‌

If you believe information concerning a minor was submitted to Goxee, contact privacy@goxeedealer.com so Goxee can investigate and take appropriate action.‌

12. Changes to This Policy‌‌

Goxee may update this Privacy Policy to reflect changes in law, technology, Services, or business practices. Goxee will post the updated Policy at this URL and revise the Last Updated date. If a change materially affects how Goxee uses Personal Information, Goxee will provide additional notice or obtain consent when required by law.‌
